This whole case is amazing. Diebold have repeatedly tried to use copyright law and anti-circumvention laws like the DMCA to shield themselves from scrutiny. Ed Delten at www.freedom-to-tinker.com is really good on a lot of the technical issues behind this, if anyone's interested.
